Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Meezoy (operated by Meezoy Ventures Private Limited, "Company," "we," "us," or "our"). By accessing or using the Meezoy mobile application, website, and related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Meezoy Is a Marketplace

Meezoy is an online marketplace and an intermediary. It provides a technology platform that lets customers discover independent Local Partners and book activity experiences with them, such as coffee, food and shopping at public places. Meezoy does not itself provide these experiences.

The booking is an agreement between the customer and the Local Partner

  • The customer chooses the Local Partner, the activity, the date, the time and the place, and the Local Partner chooses whether to accept. A booking exists only when both of them have agreed to it.
  • The agreement for the experience is made directly between the customer and the Local Partner. Meezoy is not a party to it and does not take part in, supervise or control the experience.
  • Local Partners are independent and are not employees, agents, contractors or representatives of Meezoy. Customers are responsible for their own choices and conduct.
  • Meezoy collects payments for bookings on behalf of Local Partners as a limited payment collection agent, keeps its fees and commission, and passes the Local Partner's share to them. Collecting a payment does not make Meezoy a provider of the experience.

What Meezoy does, and what it does not

We take reasonable steps to make the marketplace safer, such as verifying Local Partners, listing public Verified Spots, offering in-app messaging and acting on reports. These steps reduce risk but cannot remove it, and they are not a promise about any person, place or outcome. Meezoy has no control over the behaviour of customers or Local Partners, or over venues, transport, weather or other third parties.

To the maximum extent permitted by law, Meezoy is not responsible for any act, omission, statement or conduct of a customer or a Local Partner, or for any incident, accident, injury, illness, loss, theft or damage to person or property that happens before, during or after a booking, including at a venue or while travelling. Any claim arising from the experience itself lies between the customer and the Local Partner. This does not limit any liability that cannot be excluded by law, including for Meezoy's own fraud or gross negligence.

3. Eligibility and Verification

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

Guardian Consent (India): Meezoy is only for adults aged 18 or over, and we do not knowingly allow anyone under 18 to use it. In line with the Digital Personal Data Protection Act, 2023, if you are a person with a disability who has a lawful guardian, your guardian must give verifiable consent before you use the platform. We do not carry out targeted profiling, tracking or behavioural monitoring of minors.

Verification Disclaimer

While we may perform certain background checks or identity verification processes on users, we do not guarantee the accuracy or completeness of such checks. You acknowledge that Meezoy does not assume responsibility for the accuracy of any user-provided information or the reliability of any third-party verification service.

Users are solely responsible for their own safety and for conducting their own due diligence before engaging in any interaction with other users.

4. User Accounts and Security

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information and to update such information to keep it accurate and complete.

  • You are responsible for safeguarding your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to disable any account at any time for any reason.

5. User Content and Conduct

Users may post profiles, photos, reviews, and messages ("User Content"). You retain ownership of your User Content, but you grant Meezoy a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating the Service.

You represent and warrant that your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Providing or seeking sexual services, escort services, or any form of illegal activity.
  • Harassing, stalking, threatening, or harming other users.
  • Behaving inappropriately towards another user, in the app or in person, including abusive or discriminatory language, unwanted physical contact, romantic or sexual advances, pressuring someone to go to a private place, or being drunk, under the influence of drugs, or aggressive during a booking.
  • Photographing or recording another user without their consent, or sharing their personal details.
  • Using the Service for any unauthorized commercial purposes.
  • Circumventing the platform's payment system to avoid fees.
  • Impersonating any person or entity.
  • Using automated systems (bots, scrapers) to access the Service.
  • Posting false, misleading, or deceptive information.

Consequences of misconduct. These rules apply equally to customers and Local Partners. If you break them, the other person may end the booking immediately and Meezoy may cancel it. If a customer is responsible, no refund is given and the amount paid online, travel charges, credits and coupons used on that booking are forfeited. If a Local Partner is responsible, the customer is refunded in full and the Local Partner receives no earnings for that booking; earnings not yet paid out may be held while we investigate. In either case we may suspend or permanently close the account, and we may share relevant information, including booking details and in-app messages, with the police or other authorities where we believe it is needed to protect someone's safety or to report a crime. Details are in Section 10 of our Refund & Cancellation Policy.

7. Intellectual Property Rights

The Service, including all text, graphics, logos, and software, is the property of Meezoy or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

8. Third-Party Services

The Service may contain links to third-party websites or services. Meezoy does not own or control these third-party services and assumes no responsibility for their content, privacy policies, or practices.

9. Assumption of Risk and Disclaimers

Meeting someone new carries some risk. By booking or accepting a booking, you agree that you take part voluntarily and at your own risk, that you will use your own judgement, and that you are responsible for your own safety, health and belongings. Leave any situation where you feel unsafe and contact the police on 112.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEEZOY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  • We do not guarantee that the Service will be uninterrupted, timely, secure or error-free.
  • We do not guarantee the conduct, quality, safety, suitability or legality of any experience, customer or Local Partner.
  • We do not guarantee the identity, background or intentions of any user. Verification reduces risk but is not a guarantee.
  • We do not guarantee the safety, condition, opening hours or prices of any venue, including Verified Spots, which are run by third parties.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEEZOY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEEZOY'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR A BOOKING IS LIMITED TO THE FEES AND COMMISSION MEEZOY ACTUALLY RECEIVED FOR THE BOOKING THAT GAVE RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING YOUR RIGHTS UNDER THE CONSUMER PROTECTION ACT, 2019.

11. Indemnification

You agree to defend, indemnify, and hold harmless Meezoy and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from your use of the Service, your conduct towards another user, any booking you make or accept, your violation of these Terms, or your violation of any law or third-party rights.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Please contact our Grievance Officer first (Section 16) so we can try to resolve the matter. If it is not resolved within 30 days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement between you and Meezoy or, failing agreement, under that Act. The seat and venue of arbitration shall be Hyderabad, Telangana, and the language shall be English.

INDIVIDUAL CLAIMS ONLY: to the extent permitted by law, you and Meezoy may bring claims against each other only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. This section does not prevent you from approaching a consumer commission where the law allows.

13. Governing Law

These Terms are governed by the laws of India. Subject to Section 12, the courts at Hyderabad, Telangana, have exclusive jurisdiction.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. If your account is suspended or closed for misconduct, the booking where the misconduct happened is handled as described in Section 6. Your other upcoming bookings may be cancelled: a customer is refunded for those under our Refund & Cancellation Policy, and when a Local Partner's account is closed their customers are refunded in full.

15. Miscellaneous

These Terms constitute the entire agreement between you and Meezoy regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

16. Grievance Officer and Contact

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, you can raise any complaint about the Service, a booking or another user with our Grievance Officer. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.
